Terms of Service

1. Acceptance of Terms

By accessing or using Konduit (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Konduit is a data intelligence platform that scores, ranks, and surfaces residential real estate opportunities sourced from licensed MLS and third-party data feeds. Konduit is not investment advice, not a real estate broker, not a lender, and not a fiduciary. The Service is informational only.

3. Beta Status

The Service is in beta. Features may change, be removed, or be re-priced without notice. No service-level agreement (SLA) is guaranteed during beta. Data availability is subject to upstream licensing arrangements (FMLS, RentCast, FEMA, and others).

4. Eligibility

You must be at least 18 years old and have the legal capacity to accept these Terms. By using the Service you represent that you meet these requirements.

5. Account Responsibility

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately of any suspected unauthorized use.

6. Acceptable Use

You agree not to:

  • Scrape, crawl, or bulk-extract data from the Service.
  • Resell, sublicense, or redistribute Konduit data or scores.
  • Reverse engineer, decompile, or attempt to derive the scoring methodology or weighting of the underwriting models.
  • Use the Service for any unlawful purpose or in violation of MLS, lender, or fair-housing regulations.

7. Data Ownership

Konduit and its licensors own all rights in the Service and the derived data products (scores, components, audit trails). You retain ownership of your account notes, bookmarks, and any user-generated content you create within the Service.

8. Disclaimers

KONDUIT IS NOT INVESTMENT ADVICE. KONDUIT IS NOT A REAL ESTATE BROKER. KONDUIT IS NOT YOUR FIDUCIARY. INVESTMENT DECISIONS YOU MAKE BASED ON THE SERVICE ARE YOUR SOLE RESPONSIBILITY.

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Konduit does not warrant that data is accurate, complete, or current.

9. Limitation of Liability

To the maximum extent permitted by law, Konduit’s total liability for any claim arising out of or relating to the Service shall not exceed the fees you paid to Konduit in the twelve (12) months preceding the claim. Konduit shall not be liable for indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold harmless Konduit, its affiliates, and its personnel from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Exclusive venue for any dispute shall be the state or federal courts located in Fulton County, Georgia.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to active users by email or in-product notice. Continued use of the Service after the effective date of an update constitutes acceptance of the updated Terms.
